Privacy Policy

Last Updated: 5/12/23

BusinessU (“BU”) is owned and operated by Business U LLC. BU holds the privacy and security of our site’s visitors, Licensees, and Students as one of our highest priorities. This Privacy Policy explains the services accessed, what information is gathered, and what happens with that information.

BU is a web-based learning management system (LMS). BU provides a suite of learning management tools. Potential Licensees (Teachers) can access BU through a free trial account. Licensees (Teachers) access BU by purchasing a license. Students and Licensees can access BU through the Licensee's (Teacher's) license.

This Privacy Policy describes BU’s privacy practices in relation to information that we collect through the website businessu.org operated by us, made available by us for use on or through computers and/or mobile devices that link to this Privacy Policy.

What Information is Collected?

Visitors: IP Addresses, Operating System, Browser Type, and Referring URLs are tracked with our website logs. This information is collected for security purposes and is in no way used to detect the user’s identification.

Free Trial Visitors: Teachers signing up for a free trial account are required to provide us with an email address, first and last name, city, state, and organization (school/site name). This information is necessary so that we may: 1) send emails for Teacher Dashboard set up instructions, 2) reply to any questions, 3) send information about new products, updates, etc, and/or 4) send information about scheduled application server maintenance or other support matters. We do not sell or share any of this information to outside companies for any reason.

Licensees: Licensees (usually a school/district/teacher) are required to provide email, first name, last name, city, state, and organization (school/site name).

Students: Students gain access to secure application servers using a password protected ID provided to them by their Licensee (teacher). We collect information about each Student’s session such as content visited, time on task, and assessment scores. This information is collected and organized to help the Licensee make observations to improve the learning process. To that end, the Licensee may optionally enter Student names on the servers. These procedures and technologies are to improve the Student learning process and are in compliance with the Family Educational Rights and Privacy Act (FERPA).

Additional Information: Licensee and Student data is the only information gathered. Once a license expires, this data is archived on BU’s secure servers in the event the Licensee renews their license in the future and wants access to the stored data. If the Licensee or school/site desires this information to be permanently deleted, the Licensee can email support@businessu.org and type “delete stored data” in the subject area, and include the Teacher ID that was issued by BU. If a Licensee desires to challenge the accuracy of the Student or Licensee data being gathered, the school or Licensee can email support@businessu.org and formally inquire.

Under age 13: BU is COPPA compliant. BU requires schools, districts, and/or Licensees (teachers/instructors) (on behalf of the parents or legal guardians of Students under the age of 13) to provide consent for the online collection of personal information of the Student under the age of 13. In order to use BU, Students must gain access credentials provided to them by their teacher (Licensee).

BU collects limited personal information from minor Students only where that Student’s school, district, and/or Licensee has contracted with BU to collect personal information for the use and benefit of the learning environment. This information is not shared outside of the school/district or with any third parties except those needed for the provision of the service as outlined in this policy. Students of any age cannot share their profiles publicly outside of their classroom or school.

Licensees can give Students grades, and provide comments to Students. Students can submit assignments, take quizzes, and upload additional work. Licensees and Students can record audio and/or video recordings and upload/attach these recordings to the BU LMS. None of this information is shared with any third parties without proper consent.

Licensees accessing BU on behalf of a School or District or using a free account must ensure parents or legal guardians have access to this privacy policy.

Other Information

For the purpose of improving and enhancing its service, BU collects and analyzes data on how the system is used in the aggregate (how groups of people use BU). As true of most websites, we gather certain information automatically and store it in log files. This information may include internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data. We also use tracking technologies from third party service providers to gather information regarding the date and time of visits and the information interacted with. We may link this automatically collected data to personally identifiable information. We do not share this information with third parties.

Information on individual usage of the system, including but not limited to individual IP addresses, may be analyzed on a case-specific basis to resolve a technical difficulty or to assist in resolving or investigating any misuse of the service. Such individual usage information may be furnished to the Licensee if the Licensee requests such information, to assist in the investigation of fraudulent, abusive, or criminal activity or any other use of BU that violates your Licensee's rules or policies. For any known breaches of data, BU will notify any user attached to a license, that their personally identifiable information (PII) may have been compromised, within 24 hours, via email.

Tracking Technologies

Cookies and Local Storage Objects (LSOs) such as HTML5 Local Storage / IndexedDB / etc are used to store current authentication information, content information, and user preferences. Third party companies with whom we contract to provide certain features on our site, such as utilization statistics, customer support, product stability, error reporting, and video delivery, use cookies and LSOs to collect and store information. Beyond these third-party contractors, this information is never transmitted to other third parties.

These technologies are used to administer the site, track users’ movements for internal / teacher / district administrator reporting, analyze trends, provide customer support, to store authentication information, and to inform site enhancements. We may receive reports based on the use of these technologies by these companies on an individual as well as aggregated basis.

Review and Deletion of Your Child’s Information

Parents have the right to refuse the use of the site for their child. Parents can access their child’s information and request to have it deleted by contacting their Licensee.

If you are the parent and guardian of a Student using BU, and cease to agree with BU’s terms of use and/or privacy policy at some point in the future, you may opt-out by contacting (a) your Licensee, or (b) BU at support@businessu.org.

We will retain Student information for as long as the account is active or archived, or as needed to provide services. We will retain and use the information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Internet Privacy & Security

BU and the Licensee work together to protect the online privacy of all of users, including Students, teachers, and administrators. This privacy policy and BU’s information collection and security practices have been authorized by the Licensee, and BU strives to manage Licensee's internet services in a secure manner. For example, BU uses industry-standard technology called SSL (Secure Socket Layer). SSL encrypts information transmitted across the internet to and from BU. Unfortunately, no data transmission over the internet can be guaranteed to be 100% secure and “hacker-proof,” and BU cannot ensure or warrant the security of any information managed by the site, whether transmitted to BU by you, or your Licensee. BU shall not be liable if a security breach occurs, if the site malfunctions, or if information is misused or mismanaged in any way to your detriment or the detriment of a third party, whether by BU, Licensee, or any other authorized or unauthorized third party.

Changes to this Privacy Policy

BU reserves the right to change or update this Privacy Policy at any time, so please review it frequently. If we decide to change our privacy policy, we will post those changes to this privacy statement, the homepage, and/or other places we deem appropriate. Any changes or updates will be effective immediately upon posting to the site.

Third Party Information Dissemination: BU does not share or sell customer, visitor, Licensee, or Student information to third parties.
